垫资是指城投公司或施工单位带资承包，相当于变相融资，法律规定政府作为业主的公益性项目严禁带资承包，不得拖欠工程款，此类项目都必须先有预算，在预算内进行支付，垫资则往往是在无预算或超预算的情况下，这样就会产生政府隐性债务。但是不能仅看到施工单位垫资就认定为隐性债务，需要穿透看垫资施工中的欠款方是否为政府。如果是城投公司欠施工单位工程款，而非政府欠款，不是财政资金偿还也无政府全额担保或补助，则不会产生隐性债务，而是属于关注类债务。
